Amid public and personal pressure, the Mayor's Chief of Staff Christine Beatty is scheduled to announce today that she will resign.
Beatty will submit her letter of resignation today, though it will not be effective immediately.
There has been much media speculation as to the location of Beatty; she has not been seen publicly since the Detroit Free Press broke the story about the steamy sex text messages she exchanged with the Detroit Mayor, Kwame Kilpatrick.
According to several sources the media has made their home in front of the Manoogian Mansion, where the Mayor and his family lives waiting on a statement from him. Mayor Kilpatrick has not yet addressed the media concerning this scandal.
Kwame Kilpatrick, a one-time rising star in American urban politics who embraced his "Hip-Hop Mayor" image as Detroit's youngest elected leader, was charged Monday with perjury and other counts after sexually explicit text messages surfaced that appear to contradict his sworn denials of an affair with a top aide.
Wayne County Prosecutor Kym Worthy also charged the charismatic and popular yet polarizing 37-year-old mayor with obstruction of justice and misconduct in office.
Former Chief of Staff Christine Beatty, 37, who also denied under oath that she and Kilpatrick shared a romantic relationship in 2002 and 2003, was charged with perjury and obstruction of justice.
In all, Worthy authorized a 12-count criminal information.
"This case was about as far from being a private matter as one can get. Honesty and integrity in the justice system is everything. That is what this case is about," Worthy said at a news conference.
"Just when did honesty and integrity, truth and honor become traits to be mocked, downplayed, ignored, laughed at or excuses made for them? When did telling the truth become a supporting player to everything else?"
The charges could signal the end of Kilpatrick's six-year career as mayor of one of America's largest cities.
Perjury is a felony, punishable by up to 15 years in prison. But for Kilpatrick, a conviction also would mean his immediate expulsion from office. The Detroit City Charter calls for any elected official convicted of a felony while in office to be removed.
The mayor's office sent out a statement announcing a noon news conference, saying "Mayor Kilpatrick will discuss his outlook on the current legal matter and his continued focus on governing the City of Detroit."
Kilpatrick has said he would not resign and last week said he expects to be vindicated when all aspects of the scandal are made public.
Worthy said she expected the mayor and Beatty to turn themselves in no later than 7 a.m. Tuesday.
In all, Kilpatrick faces the following charges: conspiracy to obstruct justice, obstruction of justice, misconduct in office, perjury in a court proceeding and two counts of perjury other than in a court proceeding.

Worthy said she has spoken to a lawyer for Beatty but was not able to contact Kilpatrick's mayor, leaving several messages.
She also said the investigation was ongoing and other people could be charged. She said she has had conversations with the U.S. attorney, but would not elaborate.
Worthy said she and her staff have pored over more than 40,000 pages of documents since January, when the Detroit Free Press published excerpts of sexually explicit text messages sent to Beatty's city-issued pager in 2002 and 2003.
The messages contradict statements Kilpatrick and Beatty gave under oath during a whistle-blowers' trial last summer when each denied an intimate relationship.
"Witnesses must give truthful testimony, and we have to demand that they do," Worthy said. "That is why they take an oath. There are variations on courtroom oaths, but basically an oath says, `I do solemnly swear or affirm that the testimony that we are about to give in this case will be the truth, the whole truth and nothing but the truth.'
"The oath does not say, `I do solemnly swear or affirm that the testimony I'm about to give in this matter will be some of the truth, some of the time, when it suits me, and anything but the whole truth.'"
Worthy began her investigation the day after the Free Press published excerpts of the embarrassing text messages in late January. The messages called into question testimony Kilpatrick and Beatty gave in a lawsuit filed by two police officers who alleged they were fired for investigating claims that the mayor used his security unit to cover up extramarital affairs.
In court, Kilpatrick and Beatty denied having an intimate relationship, but the text messages reveal that they carried on a flirty, sometimes sexually explicit dialogue about where to meet and how to conceal their trysts.
The lawsuit ended with the jury awarding $6.5 million to the two officers in September. A defiant Kilpatrick vowed to appeal the verdict, but a month later said settling the suit was in the best interests of Detroit. The city agreed to pay out $8.4 million to the two officers and a third former officer who filed a separate lawsuit.
Documents released last month showed Kilpatrick agreed to the settlement in an effort to keep the text messages from becoming public.
During the trial last summer, Mike Stefani, a lawyer for the officers, asked Beatty if she and Kilpatrick were "either romantically or intimately involved" during the period covered by the case.
"No," she replied, rolling her eyes.
The mayor, while on the witness stand, later went on the offensive about the allegations, defending his reputation and that of Beatty.
"I think it was pretty demoralizing to her -- you have to know her -- but it's demoralizing to me as well," he testified. "My mother is a congresswoman. There have always been strong women around me. My aunt is a state legislator. I think it's absurd to assert that every woman that works with a man is a whore."
Yet the text messages published by the Free Press revealed a romantic discourse.
"I'm madly in love with you," Kilpatrick wrote on Oct. 3, 2002.
"I hope you feel that way for a long time," Beatty replied. "In case you haven't noticed, I am madly in love with you, too!"
On Oct. 16, 2002, Kilpatrick wrote Beatty: "I've been dreaming all day about having you all to myself for 3 days. Relaxing, laughing, talking, sleeping and making love."
Kilpatrick is married with three children. Beatty was married at the time and has two children.
Kilpatrick went into a nearly weeklong seclusion after the Free Press' report. But on Jan. 30, with his wife, Carlita, at his side, the mayor emerged to apologize to Detroiters on live television for mistakes he had made, avoiding direct mention of the text messages. However, it was a confident Kilpatrick who told city residents he would see them "at work tomorrow."
For Beatty, who attended Detroit's Cass Technical High School with Kilpatrick and managed his campaigns for Michigan's state House and the mayor's office, the scandal forced her to resign.
Over the next six weeks, city lawyers and Kilpatrick's attorneys waged a futile legal battle to keep documents related to the lawsuit settlement and text messages from public eyes.
Calls for his resignation surfaced in late January from some city union leaders. Michigan Attorney General Mike Cox repeated that call, and the Detroit City Council echoed it last week with a nonbinding resolution asking Kilpatrick to step down. The council approved the $8.4 million payout but didn't know about the revealing text messages or the secret deal to keep them quiet and now is conducting its own investigation into the mayor's handling of the case.
The Detroit Free Press hasn't explained how it obtained the 14,000 text messages, which were sent or received in 2002-03 from Beatty's city-issued pager. The newspaper said it cross-referenced the messages with the mayor's private calendar and credit card records to verify events in some of the notes.
Controversy has surrounded Kilpatrick since his 2001 election as mayor.
Embraced by many Detroit residents for his boldness and confidence, Kilpatrick, then 31, embodied the new black politician and wore a diamond stud earring that helped foster his unofficial title as "Hip-Hop Mayor."
His first four years were marred by use of his city-issued credit card for expensive travel, the city's lease of a luxury Lincoln Navigator for his wife and unsubstantiated allegations of a wild party involving his security team and strippers at the mayor's mansion.
At the start of his second term, Kilpatrick vowed to not make the same mistakes and announced a residential redevelopment along Detroit's dormant riverfront, hosted a successful Super Bowl that shone a light on the city's renewal efforts and initiated other improvements.
He had been expected to seek a third term in 2009.
Perjury, obstruction of justice and misconduct charges laid by prosecutor
DETROIT - Wayne County Prosecutor Kym Worthy announced this morning that she is charging Detroit Mayor Kwame Kilpatrick and former chief of staff Christine Beatty in connection with 12 felonies including perjury, obstruction of justice and misconduct in office in a text-messaging scandal.
Kilpatrick was to be arraigned today at 5 p.m.
"President Theodore Roosevelt once said 'no man is above the law and no man is below it,' she said. "In this case we asked 'can we charge perjury? Yes. Are there other crimes and offence we can charge other than perjury? Yes. Should we charge?' Yes.
"Today we have filed a 12-count criminal information that contains charges against Mayor Kwame Kilpatrick and Christine Beatty."
Penalties for the charges range from five to fifteen years in prison. A conviction of lying under oath can bring up to 15 years' imprisonment.
Both are charged with conspiracy to obstruct justice -- a five year felony, said Worthy. " That count states that they did unlawfully conspire and confederate together with each other and others to commit obstruction of justice."
Worthy has been investigating claims the pair lied under oath during a whistle-blowers' trial last summer when they denied having a romantic relationship. Published excerpts of sexually explicit text messages left on Beatty's city-issued pager in 2002 and 2003 appear to contradict their testimony.
Kilpatrick has said he expected to be vindicated.
Worthy also accused some members of the Detroit city hall of attempting to obstruct her investigation. "We have reviewed over 40,000 pages of documents that we have obtained and talked to many witnesses," she said.
"While many individuals have been very co-operative through the course of this investigation there have been some obstacles in our way, obstacle that have caused delays for us. I have no tolerance for deliberate obstruction ... at every bend and turn there have been attempts by the city through one lawyer or another to block our investigation."

In yet another very ODD set of circumstances, it seems that an insider in the Obama campaign is intimately involved in the passport scandal that swept the Jeremiah Wright story off the front page.
John O. Brennan is president and CEO of Analysis Corporation, and also advises Senator Obama on intelligence and foreign policy matters. He donated $2,300 to Obama in January. This executive just happens to be a former member of the CIA (SPOOKS), and it is his employees that just happened to sneak a peak at Obama's passport files. Brennan had briefed the media on behalf of the Obama campaign earlier this month, and now conveniently is at the heart of a scandal that gives Obama much needed cover..
Does not take a big stretch to believe that John O. Brennan, advisor to Obama, former member of the CIA, holding a contract that gave his company access to Obama's file decided to provide the campaign an ace in the hole scandal for a rainy day...such as the Jeremiah Wright story that was quickly derailing his run for the presidency.

The DVD will come free with the premiere issue of his new mag. Francis tells E!'s Chelsea Handler, "We could release it on the internet. The problem with the internet, the minute we put it up there, even if we're charging, it's out." You mean like this?
The video in question was shot in 2003 when Dupre spent her 18th birthday partying with the GGW bus crew. The fact that she went on from there to become a high-priced call girl is just shocking.

Joe Francis's Girls Gone Wild has offered Ashley Alexandra Dupre, the ex hooker who brought down former New York Governor Eliot Spitzer, a $1 million deal for a photo spread and tour.
"Her face is on the cover of every newspaper in the country," Francis said in a statement. "It's clear that the public wants to see more of her. This is a serious offer and I hope she gets back to me right away."
Francis wants Dupre to share her side of the Spitzer story in print and DVD – though she would not have to pose nude – and tour with Girls Gone Wild.

Sure she's in South Africa to hang with her boyfriend Benji Madden and his band Good Charlotte on their tour, but Paris Hilton is a sucker for loving on orphans!
The "Hottie and the Nottie" starlet was spotted doing a little humanitarian work yesterday in Pretoria. And from the looks of it, the kids loved her.
Miss Hilton stopped by the Jacaranda Children's home for orphans to brighten up the day for the home's residents. She wore a beautiful white dress along with a Kentucky Derby-style hat as she schmoozed with the youngsters. One of them even brought her a bouquet of flowers!
And while South African orphans love her, it seems that environmentalist groups are slamming Paris for her 12-day 20,000 mile flight schedule. Apparently the heiress is using too many fossil fuels in too little time, hence increasing the pollution in the air.
U.S. Democratic presidential candidate Barack Obama delivered a major speech on Thursday, linking U.S. slipping economy with the ballooning defense budget on the Iraq war.
"How much longer are we going to ask our families and our communities to bear the cost of this war?" the Illinois senator said before a rally in West Virginia.
The U.S. economy, which was dragged by increasing budget deficit, rising oil price and lasting subprime crisis, has overtaken the Iraq war to be the top concern for American voters.
However, the Iraq war remains a focus because it has consumed billions of U.S. dollars and nearly 4,000 U.S. troops' lives but has no end in sight.
"At a time when we're on the brink of recession, when neighborhoods have 'For Sale' signs outside every home, and working families are struggling to keep up with rising costs, ordinary Americans are paying a price for this war," Obama said.
He also seized the opportunity to criticized Republican presumptive presidential nominee John McCain as the one who would persist with President George W. Bush administration's mistake on the Iraq war and tax cuts.
"No matter what the costs, no matter what the consequences, John McCain seems determined to carry out a third Bush-term," Obama said.
Arizona Senator McCain, who is on a trip to the Middle East and Europe this week, dismissed criticism from Obama, insisting the need for the U.S. to stay in Iraq in case al-Qaida militants resurge.
Some U.S. known economists said last week the Iraq war would wind up costing U.S. taxpayers about 3 trillion dollars.
A poll released on Wednesday by CNN showed that 71 percent of Americans blamed the war spending in Iraq for the country's economic woes.

Curtis, who is married to Christopher Guest and the mother of two children, says she reached a turning point two years ago when a tabloid published a photo of her and gave her weight as 161 pounds.
"I was like, `How dare you — I'm not 161 pounds!' I was indignant. I got home and I went on a scale and I was 161 pounds. I was in denial about it," she says.
"So I started a really healthy way of eating, just avoiding things that I had been shoving in my mouth. Over the course of a year, I dropped about 20 pounds," Curtis says.
"Now, I get up at (5 a.m.) every day, filled with energy. I play tennis three times a week, and I do yoga."
Curtis says growing older means paring down to an essential version of yourself.
"I've let my hair go gray. I wear only black and white. Every year I buy three or four black dresses that I just keep in rotation. I own one pair of blue jeans. I've given away all my jewelry, because I don't wear it," she says.
What about her life would she do over?
"I've been an inconsistent parent at times, and it's my greatest regret," she says. "When my daughter was small, I worked too much. I was replicating what my own mother (Janet Leigh) did."

The star of "Sex and the City" said in an interview with Grazia magazine recently, "Wow! It's kind of shocking. It's so brutal in a way, so filled with rage and anger."
The actress, who turns 43 next week, defended her look, saying, "Do I have big fake boobs, Botox and big lips? No."
Parker dismissed the opinions of the poll, which ranked her below Amy Winehouse, Sandra Oh, Madonna and Britney Spears. "Do I fit some ideals and standards of some men writing in a men's magazine? Maybe not," she said.
Still, when the magazine called her a "Barbaro-faced broad", she had to admit it hurt to be compared to a Thoroughbred racehorse.
"I guess you can't please all people," Sarah Jessica Parker said. The star of Failure to Launch and The Family Stone has certainly pleased advertisers, considering her image is prominently used to promote brand names like Garnier and Gap.
Sarah Jessica Parker may not be considered pretty by Maxim, but she has pretty interesting timing. The poll was released six months ago.
So why is she upset about it now? Why now, in March, bring up an October 2007 article that compared her to May's Kentucky Derby winner? Did her husband Matthew Broderick finally get through his stack of men's magazines?
Sarah Jessica Parker said Broderick was also offended by the article. "It has to do with his judgment too," she said. "It's condemnation, it's insane. What can I do?"
Well, she can publicly open this personal wound, just in time to get attention for her new film, Sex and the City: The Movie. The big screen version of the hit show hits theaters in a month, reteaming Kim Cattrall, Cynthia Nixon, Kristin Davis and Sarah Jessica Parker.
Kristin Davis has also made headlines recently with the emergence of a series of sex photos. The pictures were taken years ago, but were exposed in the same week as Sarah Jessica Parker's delayed complaint.

Jericho' Canceled by CBS
Skeet Ulrich series' final episode is set to air next week with a storyline intended to give fans closure

CBS has decided to end fan favorite Jericho — this time for good. After the popular but low-rated post-nuclear-holocaust drama concluded its first season, fans inundated the network with peanuts to insist that the show remain on the air. Their ploy was successful, if temporarily. Jericho, which stars Skeet Ulrich, returned in the middle of this season in an abbreviated form: Producers shot just seven episodes, including two different finales, one that hints at a third go-around and one that essentially wraps things up. It appears as if the latter conclusion is what will air next week, though sources tell The Hollywood Reporter that there is a chance the show could come back elsewhere, perhaps on cable.
CBS has released the following statement: ''The March 25th episode of Jericho will be the series finale. Without question, there are passionate viewers watching this program; we simply wish there were more. We thank an engaged and spirited fan base for keeping the show alive this long, and an outstanding team of producers, cast and crew that went through creative hoops to deliver a compelling, high quality second season. We have no regrets bringing the show back for a second try. We listened to our viewers, gave the series an opportunity to grow, and the producers put a great story on the screen. We're proud of everyone's efforts.''

Eliot Spitzer climbed the charts with a 375% gain this week. On March 10, The New York Times reported that New York Gov. Eliot Spitzer had patronized a high class prostitute service called The Emperors Club VIP. Spitzer, a first-term Democrat who pledged to bring ethics reform to Albany, is married with three children. According to published reports, investigators believe Spitzer paid up to $80,000 for prostitutes over a period of several years while he served as attorney general and later as governor. Spitzer consequently resigned from office on March 12. Searches for Spitzer's high-end prostitute, Ashley Alexandra Dupre, also skyrocketed 300% this week. Dupre, age 22, originally from New Jersey, is making the most of the publicity, working on her first recording session. MTV news reports Dupre has two tracks out, one titled "Hello, Stranger, Stranger." Interestingly, the lyrics tell the story of meeting a man late at night.
Recent reports speculating that Heath Ledger's outdated will makes no provision for his 2-year old daughter increased online interest in Ledger, up 115%. It seems the will, written in 2003, left everything to Ledger's family. Daughter Matilda was born in 2005. Although there were rumors that Matilda and her mother, actress Michelle Williams were left out of the will, Health's father assured the public they will be taken care of. "Matilda is our absolute priority and Michelle is an integral part of our family," Heath's father said in a statement. "They will be taken care of and that's how Heath would want it to be."

Back in 2003, when she was a girl going wild, Ashley Alexandra Dupré explained why she decided to strip on camera.
"You might as well show off what you have before you don't have it any more!" the future alleged call girl told the Palm Beach Post in an interview unearthed this week.
After Dupré was linked to the downfall of New York Gov. Eliot Spitzer, videos of her spring break antics turned up in the vaults of Girls Gone Wild.
At the time, as far as GGW was concerned, she introduced herself as Amber, said she was 21 (in fact, she may have been 17) and was from New Jersey – though she had just worked as a waitress in North Carolina.
She also danced without her top at a party at Miami Beach's Chesterfield Hotel.
When asked at the time by a Post reporter about the party, she said: "It got crazy. It was everything you thought it would be. ... It's not stupid to do it (take off your clothes for GGW). It's all fun and games."

Not so long ago, according to law enforcement officials, Ashley Alexandra Dupré, a.k.a. Emperors Club escort "Kristen," was earning about $1,000 an hour on trysts with folks like New York Gov. Eliot Spitzer. But Dupré, an aspiring singer, may be earning a lot more now, and legitimately -- by selling her music to "fans" online.
That, at least, is the speculation. Dupré has posted two songs on the new music-discovery site Amie Street; she put up the first, "What We Want," before she was outed, and the second, "Move ya Body," shortly afterward. (Scroll down to hear samples of each.)
Amie Street has an innovative, artist-friendly sales model. When musicians first submit a track, people can download it for free. As it becomes popular, its purchase price rises. Both of Dupré's songs are now selling at the site's maximum price -- 98 cents each.
Indeed, according to Joshua Boltuch, one of the co-founders of Amie Street, "Move ya Body" rose to its 98-cent price tag faster than any other song in Amie Street's one-and-a-half year history. Dupré posted the song early on Thursday morning; it was at the maximum price within five hours, a rate that suggests many downloads.
But how many, exactly? We don't know. Boltuch won't divulge sales numbers for Dupré or any other artist, citing company policy. "A lot of people want to know how much money she's making," he said, but only Dupré's authorized to say.
Could Dupré have made millions? It's possible. Reports suggest that her MySpace page, which links to her Amie Street profile, has seen 5 million visits in recent days.
And if she hasn't made millions, she's likely made thousands -- and in two days, that could amount to far more, per hour, than she cleared at Emporers Club.
Amie Street gives artists a 70 percent cut of each song sold. That is, Dupré is making 69 cents (yes, really) on every 98-cent track.
If she's sold at least 70,000 tracks, Dupré's made at least $48,000 -- $1,000 per hour in the 48 hours since her name went public. And this work certainly beats her old $1,000-per-hour job (though accountants in the audience will note that she's got to pay taxes on the music income, but not the escort income).
Of course, we haven't even touched other potential returns on infamy: Book deals, maybe a racy photo spread or two, maybe a real record deal, maybe John McCain's running mate (you know, for the youth vote).
Dupré would do well to act fast, of course; the public tires fast. Maybe it's happening already. On Thursday, the New York pop radio station Z100 added her song "What We Want" to its playlist. By Friday afternoon, after a poor response from the audience, the song was in low-rotation.
You had to know there was a sex tape. It's a fact of life for scandalebrities, and an alleged prostitute is certainly in the "high-risk for taped shenanigans" category.
Now, apparently the icky founder of Girls Gone Wild (read this LA Times story if you're not too clear on Joe Francis), recently released from jail, is claiming he discovered a video of Ashley Alexandra Dupre filmed with the soft-core smutpeddler back in 2003.

The pictures which appear to show the 'Sex and the City' actress performing oral sex on a man - claims which have been vehemently denied - are said to have been taken by a former lover in 1992, according to gossip website tmz
Despite initial reports suggesting a sex tape of the actress had been released, it is now believed 20 photos were sold by the ex-boyfriend to a third party, who then posted them online.
However, Kristin's representative immediately moved to quash the claims, insisting: "This is not a photo of Kristin Davis. There is no sex tape."
Kristin is not the first celebrity to be embroiled in a sex tape scandal.

Two State Department employees were fired recently and a third disciplined for improperly accessing electronic personal data on Democratic presidential candidate Sen. Barack Obama, Bush administration officials said yesterday.
The officials, all contract workers, used their authorized computer network access to look up files within the department's consular affairs section, which processes and stores passport information, and read Mr. Obama's passport application and other records, in violation of department privacy rules, State Department spokesman Sean McCormack said.
Secretary of State Condoleezza Rice was notified of the security breach yesterday, and responded by saying security measures used to monitor records of high-profile Americans worked properly in detecting the breaches.
Mr. McCormack said the officials did not appear to be seeking information on behalf of any political candidate or party.
"As far as we can tell, in each of the three cases, it was imprudent curiosity," Mr. McCormack told The Washington Times.

Lindsay Lohan's Ex Denies Existence of Sex Tape
It was only a matter of time before Lindsay Lohan was associated with a sex tape, was it not, as she has already managed to get herself into all sorts of other troubles. This one rumor though is supposedly false.
Spreading speculation that Lindsay Lohan appears in a sexy video with former boyfriend Calum Best has been nipped in the bud by the British model that Lindsay dated last year. A spokesman for Best made a statement for OK! Magazine.
"Calum knows nothing about a sex tape," the rep told OK!. "It is not him in the picture."
Lindsay Lohan's people have not made a comment yet on the matter.
The "Mean Girls" actress and the model had a short relationship last summer, before Lindsay checked herself into rehab in Sundance, Utah, at the Cirque Lodge drug rehabilitation center. She spent some two months there and left the facility in early October.
Lindsay entered rehab after an eventful summer: two arrests related to driving under the influence and possession of cocaine. Upon seeking medical help, she issued a statement admitting her life had become "completely unmanageable" due to addiction to alcohol and drugs.
In mid-November, she served 84 minutes at the Lynwood Jail in Los Angeles, complying with her court-ordered sentence. She also served 10 days of community service.
Lindsay was also ordered to attend an 18-month alcohol education program during her three-year probation as part of her sentence for two misdemeanor counts of driving under the influence and possession of cocaine.
As to her interrupted career, Lindsay is now trying to get it all back together again. Last month, she collaborated with photographer Bert Stern to recreate the famous Last Sitting, Marilyn Monroe's final photo shoot before her tragic death in 1962. The nude portraits appeared in a special issue of New York magazine.
She is reportedly working on her third studio album and she has also signed to appear alongside Jack Black in "Ye Olde Times."

Apparently, Apple has been kicking around the idea of offering free access to its iTunes library to customers who spend more upfront for an iPod or iPhone for about a year. This week, the rumor exploded all over the news, suggesting that the company might be taking the idea more seriously than it's willing to let on. It would be a major strategic switch for Apple, which has rejected subscription services in the past. But even if the company opts to try this option, it's far from clear that Apple could get away with it.
Not because of the usual suspects, either: the major music labels have long pushed for Apple to offer a subscription service to iTunes, the country's second-largest music retailer. (Subscription services are steady revenue streams, unlike 99-cent one-hit wonders, and the strangled music industry is desperate for steady revenue streams right now.) There's a small but crucial base of consumers, too, who would be thrilled at the opportunity to fill up for an extra fee, even if it's a large one. This strategy could also offer the iPod a nice boost at a time when sales have fallen flat.
No, the big reason Apple probably won't be able to pull this feat off is a simpler one: its competitors. At the moment there are still a few brave companies willing to be in competition with iTunes, and some of them, like eMusic, sell downloading subscription services. But the iPod claims about 85 percent of the MP3 player market - packaging it together with iTunes sounds a bit like bundling. That means long, expensive antitrust lawsuits that Apple could be hard-pressed to win.
For now, Apple is keeping mum. But our hunch is that music fans shouldn't save their appetites for an iTunes buffet.

The 23-year-old nurse from Mulberry, Ind., was voted off "American Idol" Wednesday, leaving 10 hopefuls to vie for the title and record contract.
Overmyer — a crowd-pleasing performer with streaked hair and a flair for southern rock — seemed to take her departure from the Fox show in stride.
"It's been a run. ... No. 11 out of all them people is more than I could expect," she told host Ryan Seacrest.
Carly Smithson and Kristy Lee Cook were the other lowest vote-getters.
Cook, a 24-year-old from Selma, Ore., has been a bottom-three fixture in the past weeks and the finalist that judge Simon Cowell picks on the most.
Cowell — who has called Cook "forgettable" and compared her voice to "Dolly Parton on helium" — continued his harsh criticism Tuesday after the country singer's take on the Beatles' "You've Got to Hide Your Love Away."
"(You're) like musical wallpaper, insomuch as you notice it, but you can't remember it," he said. "And that's what you're doing week after week: You're making no impact."
Cook talked back to the acid-tongued judge, saying: "I can blow you out of your socks, and you know it."
Wednesday's "Idol" featured a performance by season-five finalist Kellie Pickler.
Seacrest also announced this year's roster of celebrity mentors: Parton, Mariah Carey, Andrew Lloyd Webber and Neil Diamond.

University of Pennsylvania tech staffers are advising faculty and students not to upgrade their computers to the new service pack forMicrosoft s Windows Vista operating system.
The school's Information Systems & Computing department said it will support Vista SP1 on new systems where it's preinstalled, but added that it "strongly recommends that all other users adopt a 'wait and see' attitude," according to a newly published department bulletin.
Penn's ISC department advised "continuing to use previous versions of Windows XP and Windows Vista until after the initial bugs in SP1 are identified and fixed."
Vista SP1 users have reported numerous glitches since the operating system became widely available on Tuesday.
"I downloaded it via Windows Update, and got a bluescreen on the third part of the update," wrote "Iggy33", in a comment posted Wednesday on Microsoft's Vista team blog.
Iggy33 was just one of dozens of posters complaining about Vista Service Pack 1's effect on their PCs. "What a disaster," wrote "SeppDietrich", of the update. "It exiled all my Nvidia drivers to the Bermuda Triangle."
"Bikkja" said that "after installing SP1 things seem to go really slow, even though my computer shouldn't have any problems."
Other troubles reported by Vista SP1 users ranged from a simple inability to download the software from Microsoft's Windows Update site to sudden spikes in memory usage.
It's not uncommon for major software patches to cause problems when first released. Windows XP Service Pack 1 inflicted numerous glitches on host computers when it shipped in 2002. Microsoft fixed many of the problems with subsequent patches.
Penn's ISC department said computer users at the Ivy League school should have systems that employ at least a dual-core or hyperthreading processor and a minimum of 1.5 GB of RAM before considering an upgrade to Vista SP1.
That's well above Microsoft's stated minimum requirements for the operating system. The software maker recommends at least a 1-GHz, single core processor and 1 GB of RAM for the Premium, Business, and Ultimate versions of Vista.
Long before the sermons of the Rev. Jeremiah Wright became instant hits on YouTube and talk-show fodder for the cable news channels, Barack Obama knew he had a preacher problem. On the eve of launching his campaign for the White House in February 2007, Obama abruptly withdrew an invitation to Wright to deliver the invocation at his announcement speech in Springfield, Ill. Wright had been Obama's pastor for nearly 20 years. He had brought Obama into the church, helped him find his faith in God, officiated at Obama's wedding and baptized both his children. But Wright had also said a lot of incendiary things from his pulpit about America over the years, things that would be awkward to explain away for a politician hoping to unite the country and become the first African-American President of the United States.
Obama's Challenge — and Ours
For a year, Obama didn't have to explain his relationship with Wright; he didn't even have to deliver a speech outlining his views on race relations. After all, one of the animating forces behind Obama's campaign was the notion that he, and we, had somehow transcended the old racial divisions in America, that he wasn't "the black candidate" for President but a presidential candidate whose race was only part of his much broader appeal. Then on March 13, video clips emerged of Wright in earlier sermons, shouting "God damn America!" and calling 9/11 a case of "America's chickens ... coming home to roost." It became a story that threatened to capsize Obama's front-running campaign with the speed of a Wall Street bankruptcy. Obama issued a statement denouncing Wright's comments but soon realized he had to do more. And so he ordered his staff to make arrangements for him to give the speech — the speech he'd been turning over in his mind for much of his adult life. "There wasn't a discussion," says spokesman Robert Gibbs. "He made a decision." Obama went home to Chicago that night, and after his wife and two daughters were asleep, he started composing.
The speech he delivered at the National Constitution Center in Philadelphia was an artfully reasoned treatise on race and rancor in America, the most memorable speech delivered by any candidate in this campaign and one that has earned Obama comparisons to Lincoln, Kennedy and King. But that doesn't mean it will succeed in its more prosaic mission of appealing to voters who have their doubts about Obama and his preacher. It left unanswered a crucial question: What attracted Obama to Wright in the first place?
The Preacher and the Pol
When Obama joined Chicago's Trinity United Church of Christ in 1988, the Afrocentric church and its pastor held particular appeal to a 27-year-old son of an African father he barely knew and a white mother from Kansas. Obama was searching for an identity and a community, and he found both at Trinity. And he found a spiritual guide in Wright.
Much of white America is unfamiliar with the milieu of the black church. When clips from Wright's sermons began circulating, many whites heard divisive, angry, unpatriotic pronouncements on race, class and country. Many blacks, on the other hand, heard something more familiar: righteous anger about oppression and deliberate hyperbole in laying blame, which are common in sermons delivered in black churches every Sunday. The Rev. Terri Owens, dean of students at the University of Chicago Divinity School, says the black church tradition has its roots in the era of slavery, when African Americans held services under trees, far from their white masters. "Churches have always been the place where black people could speak freely," she says. "They were the only institutions they could own and run by themselves."

"Do I have fake boobs, Botox and big lips? No. Do I fit some ideals and standards of some men writing in a men's magazine? Maybe not. Am I really the unsexiest woman in the world? Wow! When Ian Usher realized he needed a fresh start, he put his entire life up for sale on eBay, from his toys to his toilet paper.
At first glance, the 44-year-old Australian who sky-dives, snowboards and rides motorbikes in his free time might seem to have a great life. But in fact he says he no longer wants it.
"The initial trigger for it was, unfortunately, the breakup of my marriage," he said.
After his five-year marriage ended two years ago, Usher decided the best way to patch up his broken heart was to pitch all his stuff and start over. In June, he's auctioning everything off on eBay.
He's currently planning to list his house, his hot tub, his clothes, his big-screen TV and his beat-up car. Usher says you can even get his friends and their dogs -- apparently, they'll be nice to you if you win.
People have bought all sorts of interesting items on eBay before: Toast with the image of the Virgin Mary burned on it went for $28,000; a sock worn by a paparazzo when he was run over by Britney Spears went for $600.
Usher thinks his life could go for up to $500,000. His ex-wife thinks he has gone mad.
"One of the phrases she used was it sounds 'a bit mental,'" he said.
Usher says he's not looking back though and is just thinking about his next big adventure.
"I plan to go to the airport, show up and see what plane has a seat available on it," he said.

Victoria Alynette Fuller (born December 11, 1970 in Santa Barbara, California, U.S.) is an American glamour model, artist, actress and reality tv contestant.

Dr. Victoria Nika Zdrok (born March 3, 1973 in Kiev, Soviet Union) is a Playboy Playmate, Penthouse Pet of the Year, a star of elaborate adult videos, an attorney, a clinical psychologist, sex therapist and former goodwill ambassador.
As a child in the former Soviet Union, Victoria listened to Voice of America on her father's clandestine radio and diligently studied English with the hope of one day coming to America. In 1989, at the age of 16, she was honored as the first Soviet teenager allowed to come to the U.S. as a foreign exchange student. She arrived on an academic scholarship, as she describes it, as "a sort of ambassador of goodwill and perestroika and glasnost."

Zdrok graduated from Pensacola Junior College in Florida at age 17 and West Chester University in Pennsylvania at age 18 with a B.A., Summa Cum Laude. She entered graduate school where she studied for a joint law and psychology program at Villanova University and Hahnemann Medical School in Philadelphia, Pennsylvania. She received her J.D. degree at the Law School and a subsequent M.A. and Ph.D. in clinical psychology. Her dissertation on "The Effect of Judicial Instructions on Jury Perception of Defendants' Refusal to Testify" was recommended for the Law Psychology Awards. She aimed to specialize in the "area where law and psychology intersect" and originally intended to become a jury consultant. She passed the bar exam on her first try. She later completed a post-doctoral qualification in sex therapy at the Robert Wood Johnson Medical School.
She was crowned Philadelphia's "Best Beauty" in August 1994. She has appeared in videos, movies, talk shows and magazines. She became October 1994's Playboy Playmate of the Month. In an interview, Zdrok claimed she would have been selected Playmate of the Year over Julie Lynn Cialini except for false rumors Zdrok said were circulated about her.
She posed for Penthouse in June 2002 as their Pet of the Month, because "the unabashed, in-your-face sexuality that Penthouse has" appealed to her more than Playboy did. In 2004, at the age of 30, she was named Penthouse Pet of the Year. She is the second woman, after Linn Thomas, to be both a Playboy Playmate and a Penthouse Pet.

Marriage to Alexander
As a seventeen-year-old foreign exchange student, she sought legal advice as to how to extend her student visa, and chose a well-known Philadelphia lawyer, Alexander Zdrok, because he spoke fluent Russian. Alexander was more than twice her age at thirty-seven, twice married, and twice divorced. Also, unknown to her at the time, he was representing mob boss John Stanfa, who eventually was sentenced to prison in 1995. Alexander subsequently proposed that Victoria marry him to get a green card and to permanently stay in America. Victoria and Alexander married in Las Vegas on October 26, 1990.
Alexander Zdrok was disbarred by the Pennsylvania Supreme Court in 1991 for forgery and deception. He was abusive to Victoria, once being arrested and jailed. There were purported threats from her husband's Mafia connections. In 1996, now 23 years old, Victoria sought a divorce. By this time a sought-after model, Victoria divorced with an agreement to pay her ex-husband 15% of all her future earnings from "pictorials, television, national and international films" and related ventures for ten years after their divorce.
In January 2001, Alexander sued her for monetary damages under the agreement, which Victoria now claimed was invalid. She also sought to seal the trial, but the court declined to do so. Victoria appealed and lost this issue. On December 9, 2003, she settled with Alexander for US$50,000. Afterwards, her ex-husband's lawyer, Elliot Goldberg, expressed disappointment over not being able to reveal intimate details about Victoria.
In March 2004, after Victoria was named Penthouse Pet of the Year, Alexander again sued to overturn the most recent settlement. The judge chastised Alexander for filing the suit.
During the trial in 2002, Victoria bore her first baby, a daughter. She was engaged to be married as of 2003.
Arriving in America two years after Victoria was her sister, a Ph.D. archeologist. Her sister also models under the names Tatiana Zdrok and Lara Buenfil and has posed topless along with their mother on the Howard Stern show.
Zdrok speaks six languages: English, Ukrainian, Russian, French, Spanish and German.
Zdrok said she plans to "phase out" her adult entertainment career. She earned a post-graduate degree in sex therapy with the goal of becoming "the Doctor Ruth of the new generation".
